By booking a photography session with Jeanette Bacon Photography, you acknowledge and agree to the following Terms & Conditions. Additional consent and release terms applicable to Adult, Family and Minor photography sessions will be provided through the relevant Photography Agreement before the session.
1. Booking & Retainer
A non-refundable retainer of 50% of the total session fee is required to secure your photography session date and time.
A booking is not considered confirmed until the retainer has been received.
The remaining balance must be paid no later than the date of the photography session and before photography begins, unless otherwise agreed in writing.
2. Cancellation & Rescheduling
The 50% retainer is non-refundable as the agreed date and time have been reserved specifically for your photography session.
Where reasonable notice is provided, the retainer may be transferred once to a new session date, subject to the availability of Jeanette Bacon Photography.
Repeated rescheduling, late cancellation or failure to attend the scheduled session may result in the retainer being forfeited. A new retainer may then be required to secure another booking.
3. Weather & Outdoor Sessions
Outdoor photography sessions may need to be rescheduled due to rain, strong wind, unsafe conditions or other weather that would significantly affect the photography session.
Jeanette Bacon Photography will make the final decision regarding weather-related rescheduling.
Where Jeanette Bacon Photography reschedules a session because of unsuitable weather, the retainer will be transferred to the new agreed date without penalty.
4. Photographer Illness, Emergency or Unforeseen Circumstances
If Jeanette Bacon Photography is unable to photograph the session because of illness, emergency or circumstances beyond reasonable control, every reasonable effort will be made to arrange a suitable replacement date.
Where a replacement date cannot reasonably be arranged, payments received for photography services that were not provided will be refunded.
5. Arrival & Session Time
Clients are responsible for arriving at the agreed location at the scheduled time.
Late arrival may reduce the photography time available. Where another booking or commitment follows the session, the session cannot necessarily be extended.
6. Creative Direction & Artistic Discretion
Jeanette Bacon Photography retains professional and creative discretion regarding posing, composition, lighting, location, camera settings, photographic techniques, editing style and the overall creative direction of each photography session.
Client ideas and inspiration are always welcome; however, specific poses, photographs, backgrounds, expressions or exact recreations of reference photographs cannot be guaranteed.
Every reasonable effort will be made to accommodate reasonable requests where possible.
7. Image Selection
Not every photograph captured during a photography session will be delivered.
Jeanette Bacon Photography will professionally select the strongest photographs from the session.
Test photographs, duplicates, missed focus, closed eyes, unsuitable expressions and photographs that do not meet the photographer’s professional or artistic standards may be removed during the selection process.
Photographs that are not selected for the final collection are not considered part of the finished product and will not be supplied.
8. Number of Final Images
The number of final edited photographs delivered will be determined by the photography package booked.
Where a package specifies a minimum number of photographs, every reasonable effort will be made to provide at least that number, provided the photography session can reasonably proceed as planned.
9. Editing & Retouching
Selected photographs will receive professional editing and retouching consistent with the established style of Jeanette Bacon Photography.
Editing may include adjustments to exposure, colour, contrast, cropping and portrait retouching where appropriate.
Additional or extensive retouching requested beyond the photographer’s normal workflow may incur an additional fee. Any such fee will be discussed with the client beforehand.
10. Copyright & Personal Use
All photographs and photographic works created by Jeanette Bacon Photography remain the intellectual property and copyright of Jeanette Bacon Photography unless otherwise agreed in writing.
Purchasing a photography session or photographs does not transfer copyright ownership to the client.
Upon full payment, clients receive a non-exclusive licence to use their final edited photographs for personal, non-commercial purposes, including personal printing, displaying photographs in their home, sharing them with family and friends, and posting them on personal social media accounts.
Commercial use requires prior written permission from Jeanette Bacon Photography.
11. Editing & Alteration of Delivered Photographs
Final photographs represent the artistic style and professional work of Jeanette Bacon Photography.
Clients may not alter, edit or manipulate delivered photographs in a way that changes or misrepresents the photographer’s work.
This includes applying filters or presets, AI editing or enhancement, FaceTune or similar applications, removing watermarks where applicable, or other substantial alterations.
If additional editing is required, clients are welcome to contact Jeanette Bacon Photography to discuss available options.
12. RAW, Unedited & Rejected Images
RAW files, digital negatives, unedited photographs, rejected photographs and other unfinished working files remain the property of Jeanette Bacon Photography.
These files are not included in any photography package and will not be supplied to clients.
13. Portfolio & Promotional Use
The use of client photographs by Jeanette Bacon Photography for portfolio, website, social media, advertising or other promotional purposes will be subject to the permissions provided by the client in the applicable Photography Consent & Image Usage Agreement.
Where a client has communicated and agreed upon restrictions regarding promotional use, Jeanette Bacon Photography will make every reasonable effort to honour those restrictions.
14. Behind-the-Scenes Photography & Video
Jeanette Bacon Photography may offer clients the option to consent to behind-the-scenes photography or video during a photography session.
Participation is optional and will be subject to the permission provided in the applicable Photography Agreement.
Behind-the-scenes content created for Jeanette Bacon Photography’s marketing and promotional purposes does not form part of the client’s photography package and will not be supplied as part of the final gallery.
15. Turnaround Time
Final edited photographs will normally be delivered within approximately 14 days following the photography session.
Although every reasonable effort will be made to meet this timeframe, delays caused by illness, technical difficulties, unusually high workloads or other unforeseen circumstances may occasionally occur.
The client will be informed should a significant delay arise.
16. Image Delivery & Storage
Final photographs will be delivered digitally using the agreed delivery method.
Clients are responsible for downloading and safely backing up their photographs after delivery.
Jeanette Bacon Photography will endeavour to retain delivered photographs and/or online galleries for up to 12 months following delivery. Storage beyond this period cannot be guaranteed.
17. Location Fees & Permissions
Certain photography locations may require entrance fees, permits, booking fees or permission to photograph.
Any known additional costs and responsibility for those costs will be discussed and agreed upon before the photography session.
18. Client Responsibilities
Clients are responsible for their own conduct and, where applicable, for the supervision and behaviour of children participating in the photography session.
Clients are expected to follow reasonable instructions relating to the photography session and the safety of participants.
19. Technical Failure or Loss of Images
Jeanette Bacon Photography takes reasonable precautions to safeguard photographs created during each session.
In the unlikely event that photographs are permanently lost, corrupted or cannot be delivered due to equipment failure, memory card failure, data corruption or another circumstance beyond the photographer’s reasonable control, Jeanette Bacon Photography will, where reasonably possible, offer a replacement photography session.
Where a replacement session cannot reasonably be arranged, liability for the affected photography services will be limited to the amount paid for those services.
20. Limitation of Liability
While every reasonable care will be taken during a photography session, Jeanette Bacon Photography shall not be held liable for accidents, injuries, illness, loss of personal belongings or damage to personal property occurring during the session, except where caused by proven negligence.
21. Privacy
Personal information supplied to Jeanette Bacon Photography will be used for purposes relating to photography bookings, communication, providing photography services, maintaining business records and complying with applicable legal obligations.
Personal information will not be sold or knowingly shared with unrelated third parties except where required by law or where reasonably necessary to provide the agreed photography services.
22. Photography Agreements & Consent
Depending on the type of photography session booked, clients may be required to complete an Adult Photography Agreement, Family Photography Agreement or Minor Photography Agreement before the session.
These agreements provide additional consent relating to photography, copyright, image usage, promotional use, minors and behind-the-scenes content where applicable.
Acceptance of Terms
By booking and engaging the services of Jeanette Bacon Photography, you acknowledge that you have read and understood these Terms & Conditions and agree to be bound by the terms applicable to your booking.
Where a separate Photography Agreement is required, the applicable agreement must also be completed before the photography session.
